Confidential data
Pursuant to § 33 of the Act on Biocidal Products (BP Act), the applicant has to denote any data considered by him as a company or business secret to ensure their confidential treatment. The proof of a company or business secret has to be provided. Data that cannot in any case be considered confidential are listed under § 33 (3).
The applicant should specifically mark confidential data in hard copy (e.g. in a separate folder) and electronically (in a separate file or folder marked as "confidential").
Data protection
Provisions for data protection which are to be applied to the data and studies of a BP submitted to the authority are specified in § 31 (1)-(3) of the BP Act and further explained in a guidance document agreed between the EU Member States and the European Commission.
