
Provisions for Biocidal products may also comply with other statutory provisions in addition to the Act on Biocidal Products if applicable.
• The Chemicals Law (Chemicals Act 1996, Federal Legal Gazette I No 53/1997 and Chemicals Ordinance 1999, Federal Legal Gazette II No 81/2000, last amended by Federal Legal Gazette II No 186/2002) applies to biocides with regard to their classification, labelling and packaging, and for the compilation of safety data sheets. The requirements on test reports for applications as well as for information obligations are also specified in the Chemicals Law.
• Where applicable, the requirements of the Poison Ordinance (Federal Legal Gazette II No 24/2001) and the Poison Information Ordinance (Federal Legal Gazette II No 137/1999 as amended) must be complied with.
• In addition to the Act on Biocidal Products, the EU Detergent Regulation (Regulation (EC) 648/2004) applies e.g. if the antibacterial effect of a detergent is above average.
• For materials and treated articles that are not labelled as biocidal products, the provisions under the Food Act (Federal Legal Gazette No 86/1975 as amended) apply.
• The Spas Hygiene Act (Federal Legal Gazette No 254/1976 as amended) and the Ordinance on Stored Products Protection and Pest Control (Federal Legal Gazette No 652/1993) (the latter within the legal framework of the Biocidal Products Act) are still in force.
• The Protection of Employees Act (Federal Legal Gazette I No 450/1994 as amended) and the Ordinance on Limit Values (Federal Legal Gazette II No 253/2001 as amended) lay down provisions for the production of active substances and biocidal products as well as for the professional treatment of materials with biocidal products. The Protection of Employees Act also applies to the labelling of microorganisms used as active substances.
• The performance of studies and tests on biocidal active substances and products must comply with the Animal Experiments Act (Federal Legal Gazette No 501/1989 as amended) and the Animal Experiments Ordinance (Federal Legal Gazette II No 198/2000).
• Relevant national and international provisions for waste and disposal as well as limit values in environmental compartments must also be complied with. Specific regulations for individual product types (not listed here) are also applicable.
• Regulation (EC) No 689/2008 concerning the import and export of dangerous chemicals is also relevant for certain active biocidal substances, which are subject to “Prior Informed Consent“ (PIC).
